1. Legal Entity & Acceptance of Terms

ADHD Care Connect is owned and operated by Chalupa Productions LLC, a limited liability company registered in the State of Oregon ("Company," "we," "us," or "our").

By accessing or using ADHD Care Connect ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

2. Description of Service

ADHD Care Connect is an online directory that connects individuals seeking ADHD support services with professional ADHD providers. We provide a platform for providers to list their services and for users to search and contact them.

3. User Accounts

To access certain features, you must create an account. You are responsible for:

Maintaining the confidentiality of your account credentials
All activities that occur under your account
Providing accurate and current information
Notifying us immediately of any unauthorized use

4. Provider Listings

Providers who list their services on our platform agree to:

Provide accurate and truthful information about their qualifications
Maintain appropriate professional credentials and insurance
Respond to inquiries in a professional and timely manner
Not engage in misleading or deceptive practices
Comply with all applicable laws and regulations

5. Important Disclaimers

Directory Service Only

ADHD Care Connect is strictly a directory and information service. We do NOT provide coaching services, therapy, medical advice, diagnosis, treatment recommendations, or any form of mental health services. Nothing on this platform should be construed as medical or professional advice.

No Verification of Credentials

We do NOT independently verify, endorse, or guarantee the credentials, qualifications, licenses, certifications, experience, or professional standing of any provider listed on our platform. Many listings are sourced from publicly available third-party data (including Google Places) and have not been verified by the providers themselves.

No Endorsement

The presence of a provider on this directory does NOT constitute an endorsement, recommendation, or guarantee of any kind. ADHD Care Connect makes no representations about the quality, safety, effectiveness, or appropriateness of any provider's services.

User Responsibility

YOU are solely responsible for conducting your own due diligence before engaging with any provider. This includes but is not limited to: verifying credentials directly with the provider and relevant licensing boards, checking insurance and bonding status, reading reviews from multiple sources, consulting with healthcare professionals before making treatment decisions, and ensuring the provider is appropriate for your specific needs.

Third-Party Reviews

Reviews displayed on this platform may be sourced from third parties such as Google. We do not independently verify the authenticity or accuracy of these reviews. Reviews reflect the opinions of individual reviewers and not ADHD Care Connect.

Information Accuracy

Provider information including contact details, services offered, hours of operation, and pricing may be inaccurate, outdated, or incomplete. Always confirm details directly with providers before making decisions based on information found on this platform.

6. Payment Terms

Premium features are billed on a monthly recurring basis. Prices are subject to change with 30 days notice. Refunds are provided at our discretion and typically only for billing errors or service issues on our end.

7. Prohibited Conduct

Users may not:

Use the Service for any unlawful purpose
Impersonate any person or entity
Submit false or misleading information
Attempt to gain unauthorized access to our systems
Scrape or harvest data from the Service
Interfere with the proper functioning of the Service
Harass, abuse, or harm other users

8. Intellectual Property

All content on the Service, including text, graphics, logos, and software, is owned by ADHD Care Connect or its licensors and is protected by intellectual property laws. Users retain ownership of content they submit but grant us a license to use it in connection with the Service.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ADHD Care Connect, ITS OWNERS, OPERATORS, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR:

Any indirect, incidental, special, consequential, or punitive damages
Any loss of profits, revenue, data, goodwill, or other intangible losses
Any damages arising from your use of or inability to use the Service
Any damages arising from interactions with providers found through our platform
Any damages arising from the conduct or services of any provider
Any damages arising from inaccurate, incomplete, or outdated information on the platform
Any damages arising from unauthorized access to or use of our servers or your personal information
Any physical, emotional, psychological, or financial harm resulting from engaging with any provider

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU PAID TO US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for incidental or consequential damages, so some of the above limitations may not apply to you. In such cases, our liability will be limited to the greatest extent permitted by applicable law.

10. Indemnification

You agree to indemnify, defend, and hold harmless ADHD Care Connect, its owners, operators, affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses (including attorney's fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; (d) your interactions with any provider found through the Service; or (e) any content you submit to the Service.

11. Third-Party Content & Section 230

ADHD Care Connect operates as an interactive computer service that provides a platform for third-party content, including provider listings and reviews. Under Section 230 of the Communications Decency Act (47 U.S.C. § 230), ADHD Care Connect is not the publisher or speaker of third-party content.

We do not create, edit, or endorse provider listings or reviews (except those we explicitly author). Provider-submitted and third-party sourced content remains the sole responsibility of its creator.

12. Termination

We reserve the right to suspend or terminate your account at any time for violation of these terms or for any other reason at our discretion. Upon termination, your right to use the Service will immediately cease.

13. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Oregon, without regard to its conflict of law provisions.

Any dispute arising from these Terms or your use of the Service shall be resolved through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration shall take place in Portland, Oregon. You agree to waive your right to a jury trial and to participate in a class action lawsuit.

14. Changes to Terms

We may modify these terms at any time. Continued use of the Service after changes constitutes acceptance of the new terms. We will notify users of material changes via email or notice on the Service.
